The Independent Reviewer

The review is being conducted by Peter Kell, an independent reviewer with extensive experience in consumer protection, regulation and code governance.

He has previously served as Deputy Chair of both the Australian Securities and Investments Commission (ASIC) and the Australian Competition and Consumer Commission (ACCC), and as the Chief Executive Officer of CHOICE, and held a range of senior leadership positions focused on consumer outcomes, market conduct and regulatory oversight.

As Independent Reviewer, Peter will conduct an evidence-based and consultative review of the BCCC and make recommendations to support its continued effectiveness and independence.

Independence

Independent Review: Governance, Roles and Secretariat Support

The review has been commissioned by the BCCC, as required by its Charter, but is being conducted independently.

Peter Kell is responsible for determining the review approach and methodology, consulting stakeholders and developing findings, recommendations and conclusions.

Neither the BCCC nor the BCCC Secretariat will direct or influence any aspect of these.

Peter is supported by an independent secretariat that reports directly to him and operates separately from the BCCC Secretariat. The independent secretariat manages stakeholder engagement, coordinates the public consultation and receives submissions on the reviewer’s behalf.

Scope

The review will consider:

The review will also consider developments in the banking sector, changing consumer expectations, emerging issues affecting customers experiencing vulnerability, issues relevant to small business and agribusiness customers, and the implications for the BCCC of key proposals arising from the Banking Code of Practice Review.

Whether the BCCC's role, functions and powers remain appropriate and fit for purpose
Whether the BCCC's operating model and capabilities remain appropriate for the future.
How effectively BCCC performs its monitoring, investigation and oversight functions
The role and effectiveness of the Small Business and Agribusiness Advisory Panel
Whether governance arrangements support independence, accountability and stakeholder confidence
Whether current resourcing arrangements remain adequate

Matters Outside Scope

The review will not examine or make recommendations about the Banking Code of Practice itself. Issues relating to Code obligations and policy settings are being considered through the separate Banking Code Review process.

Approach

The review will adopt an evidence-based and consultative approach.

The reviewer will consider:

  • The BCCC Charter and governance framework
  • BCCC publications and reports
  • Available compliance and operational information
  • Stakeholder submissions
  • Consultation meetings and interviews
  • Relevant regulatory guidance, including ASIC Regulatory Guide 183.

Key Dates

Key Dates and Milestones for the Review

September 2026 Review Commences

The independent review commences, led by Peter Kell with support from the independent secretariat.

October 2026 Consultation Paper released

The Consultation Paper is released, setting out the issues for consideration and inviting initial submissions from stakeholders.

December 2026 Initial submissions close

The initial submission period closes. The reviewer considers submissions alongside consultation feedback and other evidence.

March 2027 Interim Report released

The Interim Report is released with preliminary findings and recommendations, opening a further period for stakeholder feedback.

May 2027 Further submissions close

The further submission period closes and the reviewer considers final feedback on the Interim Report.

June 2027 Final Report released

The Final Report is released, setting out the review's findings and recommendations.

The review will include a broad public consultation process.

Submissions are invited from:

  • customers and community members
  • consumer organisations
  • First Nations representatives
  • small business and agribusiness representatives
  • banking industry participants
  • regulators
  • professional associations
  • other interested stakeholders

Feedback will help inform the review’s findings and recommendations about the future role and operation of the BCCC.

Consultation will run throughout the review, with focused periods following the release of the Consultation Paper (October 2026) and the Interim Report (March 2027).

Confidential Submissions

Stakeholders may request that submissions remain confidential. Appropriate arrangements will be in place to protect confidential information submitted to the review.
